for online sale and reservation of tickets in the Jagiellonian University Museum, Nature Education Centre and the Botanical Garden

 


General provisions

§ 1

Terms of service for online sale and reservation of tickets in the Jagiellonian University Museum, Nature Education Centre and the Botanical Garden, hereinafter referred to as ‘The Terms’, regulate the rules of reservation and sale of entry tickets, including the online purchase of tickets, the compensation of the ticket price if the ticket is not utilised, customer complaints, as well as entitlements for reduced and dedicated tickets

 

§ 2

1. The online reservation and sale of admission tickets is operated by the Jagiellonian University, Kraków, 24 Gołębia St., NIP 675-000-22-36, REGON 000001270, hereinafter referred to as 'The University.’
2. The terms used in the Terms of service are defined as follows:
  1) Unit – JU Museum, Nature Education Centre, and Botanical Garden;
  2) Customer – each person using the current service provided by an unit, including the Consumer and Entrepreneur;
  3) Consumer – any natural person using the current service provided by a unit for the purposes not directly related to their business or professional activity;
  4) Entrepreneur – any natural person, legal person and unit of an organisation not being a legal person with legal capacity acknowledged by a separate act that carries out a product photo session for the purpose of their own business or professional activity;
  5) User – any Customer using the online ticket sale system;
  6) admission ticket – a document entitling to use the current offer of a unit as defined in the Tariff attached to the Terms;
  7) exhibition, tour route – a space dedicated for the presentation of the collections;
  8) online sale system – the https://www.bilety.uj.edu.pl webpage that enables the online purchase of admission tickets;
  9) museum classes – dedicated educational activities requiring an educational ticket.

 


Admission tickets

§ 3

1. Admission tickets are required to enter a given unit and use its offer.
2. Following types of admission tickets are available:
  1) normal ticket – entitling any person not eligible for reduced prices to enter a unit, in accordance with the conditions described in § 4.1;
  2) reduced ticket – entitling any person eligible for reduced prices to enter a unit, in accordance with the conditions described in § 4.1;
  3) dedicated ticket – entitling any person eligible for reduced prices to enter a unit, in accordance with the conditions described in § 4.2–5;
  4) seasonal ticket – entitling to enter a unit within the time limit determined by the given unit in its terms of service;
  5) all-year ticket – entitling to multiple visits for the duration of 12 months since the purchase;
  6) all-year ticket for seniors – entitling any person over 65 years old to multiple visits for the duration of 12 months since the purchase;
  7) family ticket – entitling a parent/parents or legal guardian/guardians to enter a unit with children under the age of 16;
  8) educational ticket – entitling to join organised museum classes;
  9) ticket for a personal photo session – entitles to carry out a one-hour private photo session, e.g. a wedding or family session;
  10) ticket for a product photo session – entitling to carry out a one-hour commercial photo session, e.g. a modelling or product presentation session, etc.;
  11) ticket with guide service – one-time ticket covering guide service for a single person or a group;
  12) ticket for a museum class mentioned in §2.2.9
  13) dedicated ticket – a ticket mentioned in § 4.2 and §4.4.
3. All units reserve the right to limit the number of admission tickets.
4. Purchase and reservation of tickets are possible at:
  1) each sale point of a unit;
  2) online ticket sale system.
5. Admission ticket prices:
  1) are provided in Polish Złoty (PLN);
  2) include the goods and services TAX (VAT) in the rates in force on the day of purchase;
  3) shown by the online sale system are binding at the moment when the User purchases a ticket in accordance with the Tariff attached to the Terms.
6. Any additional costs related to the purchase of tickets for a price higher than described in the tariff require a separate and clear agreement from the Customer.
7. Each client making a purchase at a stationary sale point of a given unit receives:
  1) a printed admission ticket;
  2) fiscal receipt (a customer receipt or a VAT invoice in accordance with the terms described by paragraph 9 of these Terms of Service), with the restriction that the Entrepreneur who is a VAT tax or value-added taxpayer is liable to receive an invoice if the   receipt confirming the purchase of a product photo session ticket included the NIP number used to identify the Entrepreneur for the purpose of VAT or value-added tax.
8. Each customer making a purchase in the online sale system receives:
  1) a proforma invoice saved as a PDF file;
  2) an admission ticket;
  3) an invoice only upon a request made during the ticket purchase using the online sale system.
9. The request for an invoice for an earlier fiscal purchase in a stationary sale point of a given unit must be made at the stationary sale point no later than 3 months from the time of ticket purchase only in case of:
  1) A Consumer (natural person) in possession of a receipt without a NIP number;
  2) An Entrepreneur in possession of a receipt confirming the purchase of a ticket entitling the access to the current offer provided by a unit, including the NIP number that identifies the Entrepreneur for the purpose of the VAT or value-added tax.
10. The purchased admission ticket is validated at the entrance by showing it in paper form or on an electronic device together with a document confirming the entitlement to a price reduction.
11. Although it is possible to buy a ticket in advance at the stationary sale point or the online sale system, each unit has its separate policy of ticket accessibility.

 

Entitlement for discounts and reductions

§ 4

1. The following categories of customers are entitled to purchase reduced admission tickets:
  1) public school students, university and postgraduate students, including citizens of EU member states;
  2) people over 65, pensioners and social pensioners, including citizens of European Union member states;
  3) people decorated with the Award For Protection of Historical Monuments, the Merited Cultural Worker honorary badge, For Merits for Polish Culture honorary badge, or distinguished by the honorary title For Merits for the National Culture;
  4) veterans;
  5) persons with adjudicated category III disabilities equivalent to an adjudicated minor degree of disability;
  6) ISIC and ITIC cardholders.
2. The following categories of customers are entitled to receive free dedicated tickets:
  1) donors, creators of collections by units, and their associates;
  2) people decorated with the Order of the White Eagle, the War Order of Virtuti Militari, the Order of Merit of the Republic of Poland, the Medal for Merit of Culture Gloria Artis;
  3) employers of museums listed in the National Museum Register (applies for the JU Museum);
  4) members of the International Council of Museums (ICOM) or the International Council on Monuments and Sites (ICOMOS);
  5) holders of the Polish Charter;
  6) children under the age of 4 (except children in organised groups);
  7) minors under the age of 16 with adjudicated disabilities and their guardians;
  8) persons with adjudicated I disability class equivalent to significant disability degree and their guardians;
  9) persons with adjudicated II disability class equivalent to moderate disability degree and their guardians.
3. Any supervisor of a unit may, in special cases concordant with the statutory activity of the University, decide to issue a free dedicated ticket to persons not matching the criteria mentioned in paragraph 2 on the basis of a written request describing the substantive justification sent by the Customer to the supervisor of a unit. A list of such cases must be included in the annual activity report of the unit.
4. Chargeable dedicated tickets are issued to participants of nationwide or regional cyclical educational or cultural events, e.g. the Night of Museums, Lesser Poland’s Night of Scientists.
5. Any supervisor of a unit may, in special well-founded cases, decide to issue a chargeable dedicated ticket to persons not matching the criteria mentioned in paragraph 4, excluding JU employees or entities the University holds shares of. A list of such cases must be included in the annual activity report of the unit.
6. Any supervisor of a unit is entitled to appoint a maximum of 4 open door days in a year for university and post-graduate students, as well as JU employees
7. The documents confirming the entitlement of persons to purchase reduced admission tickets or dedicated tickets:
  1) valid identity card;
  2) valid membership card;
  3) document certifying the age of its holder.

 

Purchase procedure in the online sale system

§ 5

1. The User reserves and purchases tickets using the online sale system by the means of:
  1) an individual account or
2) without registering, after providing the data necessary to realise the transaction.
2. The creation of an account requires registration, including in particular the following information:
  1) first and last name;
  2) the email address which shall be used as the User login;
  3) phone number used to contact the User.
3. The user gains access to their account using the login (User ID) and password.
4. The purchase of tickets is concluded by doing a ticket reservation in the online sale system and making the payment.
5. The online sale system has the following technical requirements:
  1) access to a personal computer or mobile device;
  2) Internet access;
  3) Internet browser installed on the personal computer or mobile device operating system (Mozilla Firefox minimum version 60.0, Opera minimum version 42.0, Google Chrome minimum version 70.0, Microsoft Edge) and PDF reader software
6. Online reservation and sale of tickets are available 7 days a week, 24 hours a day, with the exception of malfunction or necessary maintenance breaks.
7. The time of service provided by the Museum for the User purchasing a service using the online sale system depends on the type of the ticket.
8. The User must not use the online sale system to send illegal content.
9. The process of reservation and purchase of admission tickets using the online sale system is conducted according to the procedure and outline of the webpage.
10. Ticket payment is possible using the electronic payment system on the online ticket sale webpage.
11. Payment for purchased admission tickets is realised by the payment operator.
12. Payment for reserved tickets shall be made within 30 minutes from the moment of reservation. The tickets not paid for within that time are returned to the asset pool and the reservation not paid for in time is considered cancelled.
13. The User shall receive the tickets purchased in the online ticket sale system via email.


Right of withdrawal

§ 6

1. In accordance with the provisions of Art. 38(12) of the Law of 30 May 2014 on consumer rights, the right of withdrawal the contract made off-premises or by a distance is not afforded to a consumer in respect of contracts for the provision of services including recreation, entertainment, sport or cultural events event under the condition that the contract defined the time or duration of the service.
2. The provisions of paragraph 1 of this Terms of Service article are applicable to a natural person concluding a contract directly related to their business activity if the content of the contract demonstrates that it lacks professional character, especially one resulting from the subject of their business activity, made available on the basis of regulations provided by the Central Register and Information on Economic Activity.
3. Refunding an admission ticket purchased in the online sale system is not possible in cases not covered by Article 7 Paragraph 1 of these Terms of Service. The information about the lack of refund is sent at the email address submitted by the User during the process of ticket purchase.

 

Refunds for non-validated tickets

§ 7

1. Users of the online sale system are entitled to 100% refunds of the non-validated ticket price in the following cases:
1) temporary closure of a unit;
2) a decision to completely cease providing services covered by the non-validated ticket;
3) the unit changes the time of service delivery that is different than the time on the purchased ticket.
2. The refund mentioned in paragraph 1 follows the procedure described below:
1) The User sends a request for a non-validated ticket refund using the bilety.info@uj.edu.pl email address and attaching: first and last name, ticket number, date of ticket sale, the reservation date and time of a museum exhibition tour, and the bank account number that is to receive the refund, as well as an argumentation for the refund;
2) after the request is confirmed to be in accordance with these Terms of Service, the refund disposition is given. In the case of a VAT invoice, the User receives a corrected invoice. After accepting the corrected invoice, the User receives the due refund via the online payment service accepted by the Unit.

 

Complaints

§ 8

1. The User of the online sale system is entitled to make complaints concerning malfunctioning of the system, as well as the lack of or the incomplete delivery of purchased services.
2. The complaints can be sent:
1) By email under the address bilety.info@uj.edu.pl;
2) In writing to the Unit that sold the ticket.
3. The complaint shall include the first and last name of the complainant, their email or postal address enabling contact, the number of the order relating to the complaint and the reasons for making a complaint.
4. The complaint concerning the online payment service, except the information indicated in paragraph 3, shall additionally contain the transaction number, evidence of payment, the transaction amount, the first and last name of the bank account (payment card) owner, date of transaction.
5. Complaints shall be handled no later than 30 dates from the time of being made and the User shall be informed about the result of the complaint procedure by a message sent to their email address.
6. Failure to give the notification about the outcome of the complaint procedure within the time indicated in paragraph 5 shall be treated as complaint acceptance.

 

Personal data protection

§ 9

1. Your personal data is processed by the Jagiellonian University, 24 Gołębia St., 31–007 Kraków.
2. The Jagiellonian University has appointed the Data Security Officer, Biuro Inspektora Danych Osobowych, 4/27 Czapskich St., 31–110 Kraków. The Officer can be contacted by email:: iod@uj.edu.pl or by phone: 12 663 12 25.
3. Your personal data will be processed for the following purposes:
  1) the performance of the contract concerning the purchase of tickets – GDPR Art. 6 (1)(b);
  2) the performance of legal liabilities imposed on the Data Controller due to the contract – Art. 6 (1)(c);
  3) the realisation of the legitimate interests pursued by the Data Controller as regards possible redress claims or defence against claims related to the contract – RODO Art. 6 (1)(f).
4. Your personal data is necessary to conclude and execute the aforementioned contract as well as to fulfil the legal liabilities of the Data Controller. The consequence of not giving personal data will be the lack of possibility for the conclusion and execution of the contract.
5. The collected personal data may be made available to public institutions and bodies which are entitled to process personal data on the basis of common legal regulations, and to subjects processing personal data on request of the Data Controller due to the performance of their tasks.
6. The collected personal data in matters of :
  1) first name,
  2) last name,
3) email address,
will be made available to a separate data controller – a subject being the payment operator, in order to fulfil the contract mentioned in article 3 and effect the payment.
7. Your personal data will be processed for the time necessary to fulfil the contract, including mutual settlements, and for the time necessary to establish legal claims or defend from established legal claims.
8. You have the right to: access information about the processing of legal data and entitlements given by the GDPR, as well as the right to have personal data deleted from the database of the Data Controller (unless further processing is necessary to fulfil legal claims or to establish, redress, or defend from claims) and the right to limit processing and transferring of data, and to raise objections against processing – in cases and under the conditions prescribed by the GDPR.
9. Your personal data shall not be subjected to automated decisions or profiling
10. You have the right to submit a complaint to the President of the Personal Data Protection Office if you decide that the processing of your personal data breaches the regulations of the General Regulation.

 

Final provisions

§ 10

1. The University accepts no liability for administrators of email servers blocking messages sent to the email address indicated by the User of the online sale system nor for email messages being deleted or blocked by software installed on the User’s computer.
2. The Museum accepts no liability for errors made by the User accessing the online sale system due to them providing inaccurate information.
3. The University accepts no liability for transactions made by unauthorised persons who gained access to the User account in the online sale system due to neglecting safety measures while using the login and account password.
4. The Museum reserves the right to change the Guidelines. All changes to the Guidelines shall be enacted within the time indicated by the Museum no later than 14 days after they are announced in the online sale system. In the instance of Users who had made a transaction for services provided by the University before these Guidelines entered into force, the provisions of the Guidelines are binding for the User after they accept the modified version of the Terms of Service, available for any User logging into the online sale system, by clicking the relevant accept option.
